Though it may be as common as in previous years, there seems to be many more taxpayers discussing IRS Code 1301 this year. After filing a return, and checking their status, they are told to call the IRS and mention reference number 1301 to the IRS Customer Service Representative.
The code basically means that your return was filed at least three weeks ago and processing has been delayed. There are many reasons why processing might be delayed, but a particularly common one this year involves the new 2008 Recovery Rebate Credit.
An early sampling of 2008 returns showed a very large number of them had errors regarding this credit. You are supposed to use the amount you received in last year’s stimulus check to calculate the proper number for the Recovery Rebate Credit. Since most taxpayers got the proper amount last year, only a small percentage of people will actually qualify for the credit. The problem is that many people are entering the wrong amount for the credit, instead entering the amount they received last year. Though such errors are generally detected and automatically corrected by the IRS, since so many people are making the mistake longer delays are the likely result.
As of January 30th, the IRS reported that refund delays were running no longer than 1 week behind as a result of this issue. So if your return is delayed and you are in the IRS reference number 1301 group, you’ll probably only have to wait about one extra week. You can always call the IRS, just to be sure.

Hope there’s some truth to this.. Received a DD date of 2/17, then on 2/18 when no money deposited, IRS site has put my refund in the 1301 group.

this happened to us as well today….we were supposed to receive our refund yesterday. My wife FINALLY got through after 3 hours of getting hung up on and/or disconnected while on HOLD. The IRS Agent informed her that there wasn’t anything wrong with our claim; rather, the IRS was noting it was taking longer than expected for us to receive our return. He indicated that we would either get the return this Friday or NEXT, but couldn’t clarify a specific date.

I also recieved the 1301 code, called this morning and was told there was just a delay, he confirmed all my information and said that I had a new date for Direct deposit of 2/20.
Let see if this is when we will get it. My prior dates were, 2/13 as per HR Block, 2/17 as per IRS website and now 2/20 as per IRS Agent.
My fingers are crossed.

Same thing. I went into the IRS office to discuss the problem. The questioned why I thought there was a problem and I replied “because I did not get my money” She told me I should get it the 27th, but my original date was teh 13th. So, two weeks delay. We will see

As bad as the situation is, i’m actually relieved to see all of the similar comments I have. I, too, started assuming the money was in my account only to receive an email for a low-balance in my account! There I go…making assumptions again when the Fed Govt is involved. When will I learn?

I got the same 2/17 and then the 1301 on 2/18 spoke with the Irs they said it should be deposited on Friday 2/20.

I received a deposit date of 2/17, but on 2/18 received the 1301 code. Then on 2/19 received a deposit date of 2/20. My refund was deposited on 2/20, but instead of the 1101 that I expected, the amount was 285. I guess I will be calling the IRS on Monday to find out what is going on. Ugh.

I also got a 1301. I received a DD for 2/24 and I checked in 2/27 and the money was not there. Today is 3/3, its been a week and nothing!!!

Got a DD date of 2/10 and then no money but the code 1301. I have called weekly and was told on 2/28 that it would go in the next check run. It still hasn’t been changed to a new DD. Incidently when I called and they asked me to verify my address, they didn’t seem to have my new address in the system so I wonder if they even looked at my return yet.

I had a 3/3 date and have the 1301 code. Every time I call I get a different answer. No one can give me any idea when my refund will be here. It has been two weeks now and still no clue!

another 1301-er here. Filed & return was accepted on 2/23. Was told that my DD would be there by/before 3/17. Then on 3/18 I was shown the 1301 code. The rep I spoke with told me it was in error resolution, but couldn’t tell me why, and said “they usually fix it. Call back on 3/24, we can’t check into it further until then.” Called today 3/24, told the rep that I looked up the code and it just means a delay & it seems that most who are getting this code are getting large refunds from stimulus packages (either the recovery rebate credit or first time homebuyer credit) and he just kinda skipped over that, only acknowledging that those things existed and yes a lot of people filed for them. Hrm. He told me that he doesn’t see a problem with the return and that they “usually fix it” internally…and since he doesn’t show that a letter requesting more/corrected info has gone out, that usually means there’s not a huge problem & I should get my money soon. I asked if maybe they just hadn’t gotten to my return yet, he said that they “usually get on these things pretty quick.” Um, it’s been a month, that’s not quick!
Anyway, he told me to check this Friday 3/27 & next Friday 4/3 online to see if I got my money yet and then call them back if I haven’t. Sigh.

Had a DD date of 3/6. On 3/6 went into 1301, it’s now 3/26. Called IRS agent told me I would receive a letter in three to six weeks. Asked why she didn’t know. I have been paper audited befor but that is a different code. I’ll check Friday to see if anything has changed.

I filed on 3/5 and rec’vd a note stating that my DD would be 3/27. That never happened. When i called the IRS, i was told that it was reversed and was given a code 1121 online. Now I’ve been told that I will receive a letter dated 4/13 and then I “might” receive a refund within three weeks after that date. I couldn’t get no other info over the phone from the IRS.

I have been at code 1201 since I e-filed January 26,2009, return was accepted same day, I keep getting the run around, I did receive cp-05 letter March 3, waited the 3 weeks and called and was told my taxes were in the examination dept. I just want my money, plus interest, if I owed them money they would not hesitate to charge me penalty and interest,there are so many of us going through the same thing, maybe the gov.spent all the money bailing out the auto makers, and banks…

I files on 1/26 was accepted same day .Suppose to get return in 8 days nothing . Called the Irs they did not know , said call back in 3 weeks . Called back they gave me a tax advocate , tax advocate said I would get my return end of April . Did not recieve anything , called TA told me another department was looking at my return . Last Monday recieved a letter from the IRS that I would recieve my return in 6 weeks , though the IRS site stil says there is a delay in my return ?? Tax Advocate says I will not get my return because another department is looking at it . Who to believe ?? HELP !!

I filed on 01/16/2009 and it was accepted same day, I was suppose to get my refund in two weeks, then I was on 1201 code, I called they sent a cp-5 then another letter requesting some info. I sent it and still not recived my money….every time I call is a diferent story…this is increible…..

I filled my tax since last week of Jan and still have not received it and we’re in Jun going to July…This is a bad mistake from the Irs or who’s ever it is at fault!I call after 6 weeks they told me to wait 6 more and so on… got referred to a advocate office which send me a letter a week after saying they couln’t do nothing because the irs was still working on it.Called again and told them that Jun 16th pass and I have not received my refund and now the status change again in the wheres my refund to code 1301??? God only knows what that is because I have been given so manny codes and this is the most recent one.I hope this will be the last one.I hope is true what some responses are saying that it will take only one more week.Only God knows How much I need this money!

Got the error code 1301…. Was to have my refund on 2/16/10… Called IRS and they said I will get a letter that will show that I need to provide more information. I see many people had the same code but didn’t have any problems. I have been filing the same way every year and not sure why there is a problem… Looks like I won’t get a refund before April sometime… IRS was not very helpful..

Also got it this year after getting a delay on my refund today.
In my case thought it had something to do with the application of the first time homebuyer’s credit and owing taxes on 2008. So that was one way to find out…

I’ve got the best one.I filed (e-file)on 2-10 should have recieved 2-22 instead my tax’s where under review and then they(irs) put 708.00 (of 4708.00) in my bank account.I check status again and it says will send letter receieved letter and it says they (irs) will contact me in 3 weeks .Nobody to call no number no nothing.What kinda of crap is this .Has anyone else have this happen to them .

O no don’t say that I have been waiting on this 1301 thing for two weeks already and I believe it has something to do with education credits this year. I really wish I just went to HR Block instead screwing around with Tax Act. I too was given no real information when I called, he told me that the return was sent to a different department of the IRS and I couldn’t contact them and that they might send me home a letter in the mail in three weeks. He said it could take up to three weeks to get the letter and another two to four weeks to fix the errors and refile my return. I cant believe they can do this to so many people I mean if it is a delay then just say theres a delay!

We’ve been waiting for 2 weeks now on reference code 1301. When we called we were told that if we haven’t received a letter yet then this is a good thing. All tax returns are processed through a computer first and if the computer finds no problems or questions then you’re issued your refund. A human never sees your return. If there is a question (and it can pertain to anything) then it goes onto someone’s desk (code 1301) and there it will wait.. and wait.. and wait.. until the human gets to it.

I received the same error code and was told by the IRS agents that a letter had been sent to request additional information. It’s been two weeks now, still no show. Maybe its glued on to a snail and its still making its way to me. Just wondering whether or not you actually received a letter from them. I’ve been reading different posts from various sits and some individuals indicated the same problem but when they called the IRS again, they were informed that a letter was never sent. I live in New York…the number of the letter they advised me that was being sent was letter number LPR4612. Anyone else receive such a letter and, if so, what information are they requesting? Thanks.

I E-filed on Feb 1oth 2010 through Turbo-Tax and was given a est date of Feb 26th. The IRS website said by march 2nd. Then I was given the 1301 code on March 3rd. I have talked to numerous people like you all have, been told different stories, but they all say I did nothing wrong it’s a system error (something to do with the new work credit this year). But AGAIN…nothing I did??? Well then what’s the problem? Last week I was told 4-6 weeks from March 4th, and today I was told 6-8 more weeks. They also keep saying they updated the notes for me so it should make things faster. BULL!!!
I am frustrated and I am calling my local IRS office in the AM. Please do this also and maybe we can figure this out. I have not heard of anyone getting their taxes after they have received this code. Has anyone?

Therfore I called IRS spoke with a Rep and was told my taxes was being processed and to give them another week,I asked was there a problem on my end and the Rep stated know we’re just delayed. well two days later we all rechecked the web to see if any of us received a new arrival date and notice we were all given a reference code 1301. However I did call the IRS regarding this matter and was informed my taxes is still being processed which could take up to two weeks. Any Suggestions!

I have the same code. That’s our government in action for you. I filed electronically…this should be automatic. My state return was in my bank account in a couple days. I think it’s the fed’s way of delaying paying your hard earned money back to you, so they can float the interest a little longer…or possibly so they can have more time to print more cash. Do you think there’s a correlation between the delay, and the fact that our elected officials are on a spending spree and bankrupting the country? Some of the more financially strapped states are delaying paying out refunds until the fall or the end of the year.

out of curiosity, how may of the 1301ers did their taxes through turbotax? I used trubotax to file this year, as in years past, and don’t recall having entered the information from Schedule M (having to do with the stimulus money), but there it was, incorrect. Is this part of a bigger problem with Turbo Tax?

I am so upset..I did my taxes and overnighted them fro the home buyers credit. I recieved a confirmation the IRS signed them and accepted them on Jan 27th…I recieved notification that they would be deposited on March 16th and then again on March 23, then April 6, and then April 13th , and then April 27th and now I get the code 1301…so I called the IRs and of corse they tell me it is just another delay

I too received this code. I had to file a paper return, as we were receiving the First-time Homeowner’s credit. I filed at the end of January, but the IRS didn’t receive my return until Feb. 25th. I was issued an inital refund date of Mid-March. It then turned into Late March, then Early April, Mid-April, Late April, Early May, and today (4/19/2010) I received the 1301 code. I called the number indicated on the WMR website and got almost no information other than that they would forward my case to an advocate. After that I called 1-800-829-1040 (select “0″ several times and it will forward you to an operator) and finally got a few answers. In my case, the IRS is “reserving” 11 weeks to process returns with the homeowner’s credit. Since this was over the 6-8 week advertised processing time, I was assigned the 1301 code. I was also told that they are having a hard time making the computer recognize my return and process it. I have no idea what that means, but apparently they hope to have it cleared up shortly. I was told that I should receive my DD somewhere around Mother’s Day. I will let you know if it really happens. I tend to agree that the IRS seems to be dragging their feet on returns that are of high $$.

I filed in early February, saw a 1301 code by mid March, and now it is almost May and I haven’t seen or heard anything. It has been 11 weeks since I filed and the IRS website still shows “1301″ and “we have received & are processing your return”.
I’m disheartened by the fact that no one that has ever gotten a 1301 has admitted to being paid, ever. How can the government get away with this? I’m in a financial hardship and could really use my return. I wish my bill collectors were as gracious with me as I am apparently being with the government.

I efiled in January, accepted on 01/23. I was suppose to receive my refund on February 5. When I checked I got error 1301. I called IRS, was told that a letter was coming to allow two weeks.I received my letter on Febuary 16, mailed back Feb 22,2010. I followed back up on 03/26 was told that it will be out of “hold” on March 30 and that it will go into error resolution for processing and once completed from there it will go into the electronic system for processing(additional time from error resolution). I called back on April 16 was told to allow 4-6 more weeks. Tomorrow, will be 4 weeks in error resolution. UGH!!
I just finish paying for Prom.. now I’m broke … come on I still have graduation to go..

I will be receiving my return via DD on April 30, 2010, however it will be for $8000 less than my anticipated return. The IRS is disallowing my First-time Homeowner Credit, but no one can seem to tell me why.

For those who have asked, unsure about 1301, but have seen a couple of accounts regarding people receiving 1201’s in prior years where they did receive their return. 1201 and 1301 seem to be related/similar, so…I know “injured spouse” returns are manually reviewed, and average 3-6 months for receipt. Which falls in the the unfortunate 5 months reported by the above 1201 people that it took to get their money. Sorry that’s the answer! Mid-September doesn’t do much for me, either!

In the same boat! filed 02/17, every weeek my date would leap forward two weeks now its 05/11 and I have had an error 1301 for the last two weeks. refund is over $20,000 due to a legal settlement where they sent a set percentage to the government. I think its crazy that the media hasnt picked up on this, seems like it would be a great story! They need to be paying interest!

Files by mail first week of February 2010 because of first time home buyer credit. Called after 6 weeks of WMR saying “No Info available” told they had no idea, my 2010 wasn’t in the system yet, wait at least 2 more weeks because ist time home buyers credit was taking 8-12 weeks. At 8 weeks the WMR changed to by May 11th I would receive my refund. I got a letter at about 10 weeks asking for a copy of the closing statement on my home which had been attached when filed and faxed back on April 29th. WRM remained May 11th until the 12th of May when it changed to Code 1301. Called on 14th of May told no idea if the fax had been received, or what the status was, only that I was “being processed”.

I guess I’m a “1301″, I mailed my return on Feb. 26th due to homebuyer credit of $6500. I got a date in May to expect direct deposit but now the website just says my return has been received and is being processed. I’ve been told the IRS made an error that has now been corrected, that the error resolution department is handling it, that calculation of interest because of the delay is causing a delay?!, and finally by one woman that she has no idea what is the problem — one rep. told me it could take 14 months!!! Don’t plan on getting your money any time soon…

I used TurboTax too, and was a bit baffled by the question about how much my stimulus check was actually in the amount of, so I put what they stated to be “most common.” I wonder if perhaps that was wrong. TurboTax printed this one page that I’ve never submitted before, related to the stimulus check.
I filed right around 4/15/10 in Texas, and got error Code 1301 at first when I checked up on this a couple months ago, just rechecked today and see error code 1201. Don’t know if it’s a good thing that it has changed but I can see from here that calling the IRS will not help, so I’m just going to hope it comes in September and figure out my finances for now without it.

I just went to check the status of my return and also have code 1301. I mailed my return nearly 5weeks ago. I know people in the past who have gotten code 1301 and have never gotten a return. Its too bad that we cant speak directly with the people processing the refunds. The customer service rep said another dept is working on it. Im assuming i will never see my return. I guess I’ll have to try again next year.

Yeah add me to the list. I have none of the first time buyer stuff going but I do have a large refund and other then the standard 1040 I have foriegn earned tax credit. I had a DD dae of 26 October. well checked and nothing..went back to IRS site and walla ref code 1301….My taxes where done thru my CPA and all I can do now since I am in Afghanistan is rely on him as he is authorized to speak on my behalf! oh Well!

I filed my return in Feb.and expected my $6500 by March so i could close on a condo i was buying, well it is Novemeber and every month i get a letter from IRS telling me they need another 30 days to review my return. I know someone has looked at it as someone from the IRS called my company’s payroll dept to verify that I do work for the company but that was 4 months ago. I have called the IRS twice and both times they sent me a letter thanking me for the inquiry and then asked for more time.
I did close on the condo but need the refund money to cover the money that i borrowed to close. IRS does pay the interest on the money but I now would like a penalty payment they would charge me if i owed monies.

would be nice to get it before Christmas. I will never overpay my taxes again of course did not plan to this time, just got hit by the recession and made less than i thought i would.

I had 1301, sent in 2/2009, site said would be deposited in march. Day after set date, no money. then showed error 1301. called IRS (Ineffective Rude Snobby), and told lots of things. 3 said I would get a letter, and 2 others said nothing they could see would indicate a letter would be sent. Finally, months later, given tax advocate. This job is boss! You just listen to people like me say that it’s my money and I need it now, say un-hunh a few times, say I’ll work on it and then hang up. Anyway after a long time of no reasons to hold up my cash,I told advocate that I was giving the bill collectors who call her number and she could explain where their money was. The advocate had me fax all pages to her. Know what??? In 6 weeks I had my return, just like I sent it that day! THEY LOST MY RETURN AFTER STATING THAT THEY RECEIVED IT!!!!!!!!!! No wonder our country is in such bad financial trouble! You can track a bad tomato from another country, where it was sent and how many people in the USA were sickened by the diseased tomato, but they can’t find my return in the government??? Come on folks, tome for a good ol’ governmental enema!! (notice the word mental in governMENTAL). Good luck all, but keep copies of everything, because - oop- they might have lost yours too!!!!!!!!!!!!!!!

Same 1301 here. I filed 2/2/2011 was told I d get it on 2/18/2011. Then 02/25/2011. Still no money. Call h&r block again after checking irs.gov. I was told and saw 03/01/2011. I called irs they told me it was in some error dept. I then called h&r block back. They lied to me and said the irs released my funds and should hit my account. Today 3/3/2011 still no money. I don’t know about you guys but I had a closing date of 2/28/2011 to re finance my house. Nope didn’t get to so rescheduled for today. Well had to cancel again and now I m getting hit with more fee’s from broker and title company. Is this fair? Is there something I can do, maybe have h&r block give me a r.a.c.? Can it be done? Does anyone know?

Well welcome to 1301 world!!!! Sad to say but I am glad I’m not alone in this! Never had a problem with filing and/or recieving my refund before. Got the paperwork ready on Feb 4th, but was told by H&R Block rep that can’t file on 2/4 becuase of the first time home buyer loan (that we got for buying home in 2008) repayment. Rep said to wait till 2/14 the earliest before we could file. So we waited!!! We filed on 2/14 and IRS.gov website gave us an approx date of March 1st, 2011. Called IRS twice since then asking where my money were. Was told to give it 21 days for processing since the filing date. Checked IRS.gov website today and was given a reference code 1301 and a phone number to call with ext number for questions. Called IRS this monring, angry as heck, spent over an hour on the phone demending answers about what this stupid 1301 code means and why my money aren’t in my bank yet. IRS rep said nothing, knew anyting about the code at all and couldn’t answer any of my questions, and not to mention that she was very RUDE to me!!!! All she said is just to give it more time!
I am like all of you guys, beginning to give up and very upaset and frustrated, but I am pretty sure there is something we can do, voice our opinions and frustrations, and file some sort of complaint. My question is forever to those who’s got this code before 1301, DID YOU EVER FINALY GET YOUR MONEY????????????

Files on Jan 20, 2011 with tax Act,Tax Act submited the taxes on 2/15 and was accepted by the IRS the next day. Checke the IRS web site and Deposit day of 3/1/2011. Checked bank no money
called IRS spoke to agent he does not now anything about code 1301 places me on hold for over 2 hours going back and forth. Finally he gets back and says I dont know whats going on with your refund. Call back the next morning at 7:00 AM the agent makes guesses as to what it may be She says call back in 3 to 6 weeks. Call back again today 3/3 agent is still not sure in fact she tells me its happening to everyone who filed schedule A and even went on to tell me that the IRS has deleted some filings on accident and those people have to file a paper return and will have to wait for close to 2 months to even get processed.
I ask her can I charge the IRS any applicable fee and charges I may have

I have same error code look up tax advocates and call them i have talked to a really nice rep and she had me fax over the paper copy to her to try and process it again hope it works!! I really need the money now the only good thing is that after 45 days irs has to pay interest on the money they owe us! The bad thing is one re said it can take up to 149 days!!!

Code 1301 is just an internal code meaning it has been 15-21 days since you filed and are still in processing.
ALL people who are repaying the first time home buyers credit are delayed. The system was not ready as scheduled and they will start processing those returns within the next 2 weeks.
The system updates weekly, so they could get finished tomorrow and we wouldn’t know. The IRS System updates sometime between Tuesday and Wednsday nights. So it is done for this week. Hang in there it is frustrating I too am waiting but have been fortunate enough to recieve correct information finally. As for HR Block they told me 4 times that IRS had deposited my money and it wasn’t true. I think they should have to front us our money just for having told the lie.

Does anyone else think it is interesting that if you owe taxes and are a month late in paying them there is penalties and fees added to the amount of taxes owed but when the IRS is owing a refund to us we never see an extra cent

I too have been given the 1301 code, as a home buyer in 2008, this is the first year for the form 5405 (home Buyers Credit payback) attached to my usual tax return, I have contacted senators and members of congress after numerous calls to both the IRS and the Tax payers advocate with no luck what so ever. If the IRS refunds one their federal amount with 45 days from acceptance then no interest will paid if it goes to 46 days, then Interest will be paid retro back to date of acceptance, for most of us I assume that’s Feb 15, its both Congresses fault for making late changes to the legislation and the IRS for not being prepared. I have heard this so many times Sir, “we do apologize for the delay” and I was supposed to receive my refund on March 1, 2011, and I have been told that I was sent to an error resolution center in Kansas City, Missouri. No on can get a number for the resolution center. Anyone have any info on this matter call 1 616 334-5879, my cell phone number and please shed some light on the situation the IRS has put as well others in. THX

I am starting to really get upset with our wonderful Federal Government. I filed my taxes on 2.7 and because of the homebuyer credit repayment, H&R Block online held my return until 2.14. Happy Valentines Day to me! Checked the IRS.gov website in which it stated that my refund would be deposited by 3.1. However the FG always deposits on Friday’s, so should have been deposited on 2.25. I patiently but angrily waited until 3.1. Checked the irs.gov website again and they gave me the 1301 code (Gee seems to be a pattern here! hehe) So I called the toll free number as advised, waited on hold for about 5 minutes and was finally talking to a Ms. Alexander. When I gave her the all so common error code 1301, she stated without hesitation that she had no idea what that meant. After asking me a few questions and validating my identity she placed me on hold. After a minute or two waiting, she came back to the line to tell me that it has only been 2 weeks since I filed my return and the IRS has between 2 - 3 weeks to process your return. She told me that the date given on the website was basically implanted by the company that I used to do my taxes. At that point I snapped and asked her why the Federal Government would use and post information from H&R block, TaxAct, Tax Slayer or any of the other programs available. The date given was posted on THEIR website. She then reiterated that I need to wait one more week and if nothing has changed to call back. So guess what?? I did! This time to get a man on the other end of the line, in which he told me that the IRS has anywhere from 3-4 weeks to process an individuals return. I still have no money and its been almost a month since I filed! I will be calling again in the morning.

I filed on 1/29/2011. It’s now 3/18/2011 and I have not received my taxes either. I called the IRS and was told it was due to an extra form that had to be file since I claimed the home-buyers credit in 2008. So basically it takes longer when they have to take money back. Doesn’t really make sense but I simply hope I get my federal return so that my local taxes can be paid on time. I’ve never had a problem and if I knew this credit would cause so many problems I never would have taken it. Afterall, if my husband and I had purchase our home one year later we would be paying the credit back. Lots of luck to all you reference #1301 tax payers!

Was informed today by the IRS, that it will be another thirty days until we receive our refund due to 1301. So, anybody that got that code, don’t bother calling, it will be at least another 30. As my creditors hassle me unmercifully, and my hair goes a little more grey everyday, I would like to thank all involved.

I’m a member of the 1301 club. IRS has hijacked my “Fruits of my Labor” aka Money ($$) and seems to be taking that long walk to Asia…doing many sight seeing trips along the way.
Soooo, I hear that after day 46 “FORTY SIX”, I can start earning interest back to day 1 of filing? That sounds splendid. Do I get taxed on that interest and have to include that on 2011 taxes? Yet another form, and more delays. Seems like a vicious circle here.What a neat game to add to the 1301 club.The bully on the block has something that is mine and he won’t give it back. I think this year I’m going to wise up to the bully.Watch out!

As a follow up to 1301 club trilogy. I found out from one of the robotic drones that work at the IRS desk…they state there is a software glitch in their system…delaying a great deal of taxpayers their refunds. When I encouraged myself to ask if after day 46 “Forty Six” if I would start earning interests% on my refund from day one of my filing, he answered with a resounding NO. It seems my bung hole keeps getting sorer. So no more calls will be implemented to them. If no resolution is found fast, I think a great tax attorney will be a cure for what aches me in my dairy aire.

Filed on Feb 1st, accepted the 9th, but error 1301… Talked to a very nice ext 362 man who explained about the first time home buyers loan was the hold up and a glitch in the system.. He told me the glitch was being fixed and in 30 days I should see my return.. Okay, but it is the 1st of April and no return.. I called 2 weeks ago and they told me another 3 weeks.. I’m behind on credit card payments, house payment, and I’m really starting to get desperate for my money owed to me.. I think when the IRS says 30 days, that should be considered a verbal contract by that 362 man.. Interest should be added for each week they screw us!!!!!! How can a glitch that was being fixed back in February still effect me going into April??? Can’t take another 30 day reply, my credit score is relying on you United State’s government

JC, I feel your pain…as I feel we all have been mislead. It has become more common place for our U.S. Government to lie, cheat and steal without any penalty from the civilian people of this once, great country. For my experience, I paid in more taxes per paycheck, so I can have more fruits of my labor ($$)at tax time, but nope…the IRS wants to continue making money off of my money. If April 18th, 2011 hits and no refund executed…I will embark on a journey to hire an attorney to combat these goons who run IRS.

I too, am a member of this unfortunate club. Paid HR block 200 + to do my taxes and get them back ASAP, only to be told the paperwork will be held til Feb 14, then processed. Ok, that sucks, but ok. Then my ‘wheres my refund’ stated 1301, call someone. I call and talk to the most unpleasant chick alive and she snaps at me that it was HR block’s error and i will probably have to refile. I called back after speaking to HR block (anyone else seeing a circle here?) and talk to a somewhat more human lady giving me the ‘another 30 day’ lecture. This is ridiculous, you know if we owed them money they would be jumping up and down flipping out about it!

Here is a word of advice to my fellow 1301 Club members…CONTACT the “Taypayer Advocate Program” on the IRS website. They are a Non Profit Dept. that will speak to the goons at the IRS office, on your behalf, to find out in detail why they are causing havoc on your fruits of your labor($$).I will repost once I hear from the gatekeepers on my situation.
If it came down to me owing the IRS…the Goon squad would be sending me threating letters everyday and start proceeding with Liens and Levys until I begged for forgiveness and paid them money with penalties. Oh what a scam they run.

Well…I guess the government avoided a shut down. At least for the interim. As a 1301 Club member…my tax return was efiled on Feb 24th, 2011. To this date (April 14th, 2011) it has remained in processing. I only have 13 pages in my tax filing. I’m at day 49(7 weeks, I guess if they look at a page a week…then I have 6 more weeks to go. Not sure what their method of madness is… but it definetly isn’t a game I want to continue to partake in. Moral of my story: He who owe IRS on Tax deadline day better act fast, but if refund due…screw you.

DAY 63…still waiting for the Goon Squad to release my refund. They state there is 2 reasons for the delay:
1)First Time Homebuyer Credit
2)Large refund that needs W2 verification from my company
I have never dealt with such an issue before. Is the IRS just completely lost their minds? Anyone else going through the same old BS?No wonder why there is so much chaos going on this country…because they have a bunch of idiots running different departments, with NO CLUE! But I, THE TAXPAYER…keeps getting screwed everyday.

I originally filed on 01/27/11 electronically. Then it was return cause I had to wait after 2/14/11 (DON’T KNOW WHY IF I DON’T HAVE ANYTHING TO DO WITH THE HOME BUYER CREDIT). Then it was returned again cause some how my SS# was already filed. Had to mail my return on 2/22/11. Then I checked my Refund Status Results on their website and it says I will get my refund by 4/12/11. Well, that day comes and I don’t have my refund. On 4/13/11, I called the IRS cause now the status says:
We have received your tax return and it is being processed. For more information, please continue. (CONTINUE WHAT READ THE BS YOU ARE ABOUT TO GIVE ME!!!) If you have questions or need additional information,(OF COURSE I NEED ADDITIONAL INFO WHERE IS MY REFUND!!!)please have the following on hand when you call: 1)A copy of this page 2)A copy of your tax return, The SS#, Filling Status, and refund amount claimed on your return 3)Tell the representative that it has been more than 6 weeks since you filed your return.
Please mention ref # 1301 to the IRS representative.
Well I called IRS and I answered every question they ask me. They even ask if I had another job and I said no. I ask why?? They said “Just to verify. You will get your refund in a few weeks, is there anything else I can help you with.” I’m like “Heeeeello” you still haven’t told me why my refund is delayed. Ohh? (YOU STUPID IDIOT WHY U WORK THERE?)because we need to review and verify the questions you have answer for us. This conversation said nothing to me and it was a waste of time!! As of today NO REFUND!!
Again I called today and answered same questions that where asked before. Except that I was asked if I received a refund already. I said No. I was put on hold then says, Well maam it shows that you received a refund already, this is why this refund is delaying because of your SS # being processed twice.
(WHY DIDN’T THESE IDIOTS TELL ME THIS CRAP WHEN I CALLED TWO WEEKS AGO!!)I tell them this is a mistake cause I have not received any refund and I did not file twice. What am I supposed to do now? She says, this is why we are doing an investigation to see what is going on. Where is the error or if this is an ID theft case. (WITH SO MANY SCREW UPS WITH THE IRS LATELY I WON’T BE SURPRISES, THEY ARE AT FAULT, WHICH THEY WILL NEVER ADMIT!) I’m like great, how long is this going to take? She says, Well maam we received your return on 3/8/11(THIS IS 10 WKS SINCE I ORIGINALLY FILED AND WHY THEY GAVE ME A 4/12 DATE.)
and from that date its going to take 12-16 wks and if this is a ID Theft case it will take longer.(NOW THIS IS TILL THE END OF JUNE;6 MONTHS, 22 WEEKS!!!!!)That was all the rep said and now I need to wait!!! This is alot of BS from the IRS, I have nothing to do with this HOME BUYERS CREDIT or HOMEOWNERS CREDIT, I haven’t bought or going to buy a house. These codes don’t mean anything. It’s just an excuse for the IRS to play around with our hard earn money!! But do we get anything extra for their delays?? Of course NOT!!! But wait!!! They give us till April 15 to file our taxes so we won’t get penalized!! If you owe them money, you must pay with interest and whatever fees they make up if not posted by their due date!!! I am born in USA, I am a TAXPAYER, I work hard for my money!!! Never taken any help from the government. Why can’t they help by giving me what is mine if i complied with their rules!! I have never had any problems with my refund!!! Why NOW!!! They are a bunch of idiots that are train to BS us and they can do whatever they want with us!!! All they do is sit and file their nails while answering the phones which they take almost 45 mins to answer cause nowadays, everything is being process by computers not the rep personally!!! Thats why they are called reps not a accountant, that is TELEMARKETING!!! Which we ALL hate!!! They are trained to listen to our complaints, our sad stories, we can even cry to them, all because WE want our refund!! They answer with RUDENESS, BITTERNESS not a care in the world because they don’t have issues with their refunds!!! So we can all complaint to the IRS!! Write our expressions on these blogs!! We still don’t get any answers!!! We are ALL bent over and getting it HARD!!! So I wish everyone ALOT of LUCK!!! WE ALL ARE GOING TO NEED IT!!!! JUST DON’T HOLD YOUR BREATH FOR A MIRACLE!! REMEMBER THIS IS THE IRS!!! ☺☺

I still have not recieved my refund either. I have the 2008 FTHBC on mine also and filed it Feb 17th. this is rediculous. I was thinking maybe I was going to get audited and that would explain the lousy excuses from the IRS but it seems I am not the only one with the problem. This is unreal how this years taxes are being handled. And, the wait time to talk to the IRS is 10-15 minutes… really?? It wasnt that long at the peak of the tax season.

I see you have joined the 1301 club. I’m much like you…I’m in the waiting game with you. There is no consistency with the IRS goons when you call them. Each Rep/Telemarketer comes up with a new line of BS each time you call them. I filed back on Feb 24th by a very prominent CPA firm…all T’s and I’s were taken care. But yet the IRS/Government still find it common place to hijack my money. There is NO refund date in my forecast.
I WOULD RECOMMEND YOU CONTACT THE “TAXPAYER ADVOCATE PROGRAM” on the IRS website that will be your voice to getting things done. Since you can ONLY speak to the mindless worms that Big Uncle Sam puts in place to buffer our calls…the Taxpayer Advocate person will go to work on your behalf for FREE.
As of this writing I still have NO refund status in cue…but the Taxpayer Advocate will contact me by 5-20-11 if not sooner. If I DO NOT receive a satisfactory solution by then…I will go into battle with the whole goon squad that have made this filthy mistake in the first place. My attorney has been retained…we’re holding at bay while I continue to build my case…I would recommend you do the same by keeping a diary of the Agent ID’s you get from the gutless worms when you call for status updates.
I have been watching this country go to hell…perhaps these are some more signs of inadequate behavior from one of the dept’s that have such a controling interests in our daily affairs.
Perhaps the Mayans are right…the world is coming to an end?

The IRS NEEDS TO BE ABOLISHED! It’s like a kid that is going through the terrible twos and is in need of some riddlin. I have been an ongoing member of the 1301 club since Feb…but now have been side graded to the 9024 club. Here is the scenario just in case someone else is having the same problem. I had more money witheld from a weekly paycheck up and beyond my normal tax witholding. Since it was such a large refund due…the IRS is suspicious that it is a fraudulent activity. Since ALL my T’s and I’s have been dealt with…the goons still continue to not honor my money. They are holding it up day after day…causing me undue hardship.It is just like a government entity such as these idiots to continue with this circus act. I now know what it means to be screwed, Blued and Tattooed!

Finally…the day has arrived. Friday the 13th notheless. The refund was readily accepted. Now I move on from the 1301 club…but until the next tax year. See you in 2012.
