Though it may be as common as in previous years, there seems to be many more taxpayers discussing IRS Code 1301 this year.  After filing a return, and checking their status, they are told to call the IRS and mention reference number 1301 to the IRS Customer Service Representative.

The code basically means that your return was filed at least three weeks ago and processing has been delayed.  There are many reasons why processing might be delayed, but a particularly common one this year involves the new 2008 Recovery Rebate Credit.

An early sampling of 2008 returns showed a very large number of them had errors regarding this credit.  You are supposed to use the amount you received in last year’s stimulus check to calculate the proper number for the Recovery Rebate Credit.  Since most taxpayers got the proper amount last year, only a small percentage of people will actually qualify for the credit.  The problem is that many people are entering the wrong amount for the credit, instead entering the amount they received last year.  Though such errors are generally detected and automatically corrected by the IRS, since so many people are making the mistake longer delays are the likely result.

As of January 30th, the IRS reported that refund delays were running no longer than 1 week behind as a result of this issue.  So if your return is delayed and you are in the IRS reference number 1301 group, you’ll probably only have to wait about one extra week.  You can always call the IRS, just to be sure.

    Hope there’s some truth to this.. Received a DD date of 2/17, then on 2/18 when no money deposited, IRS site has put my refund in the 1301 group.

    this happened to us as well today….we were supposed to receive our refund yesterday. My wife FINALLY got through after 3 hours of getting hung up on and/or disconnected while on HOLD. The IRS Agent informed her that there wasn’t anything wrong with our claim; rather, the IRS was noting it was taking longer than expected for us to receive our return. He indicated that we would either get the return this Friday or NEXT, but couldn’t clarify a specific date.

    I also recieved the 1301 code, called this morning and was told there was just a delay, he confirmed all my information and said that I had a new date for Direct deposit of 2/20.

    Let see if this is when we will get it. My prior dates were, 2/13 as per HR Block, 2/17 as per IRS website and now 2/20 as per IRS Agent.

    My fingers are crossed.

    Same thing. I went into the IRS office to discuss the problem. The questioned why I thought there was a problem and I replied “because I did not get my money” She told me I should get it the 27th, but my original date was teh 13th. So, two weeks delay. We will see

    As bad as the situation is, i’m actually relieved to see all of the similar comments I have. I, too, started assuming the money was in my account only to receive an email for a low-balance in my account! There I go…making assumptions again when the Fed Govt is involved. When will I learn?

    I got the same 2/17 and then the 1301 on 2/18 spoke with the Irs they said it should be deposited on Friday 2/20.

    I received a deposit date of 2/17, but on 2/18 received the 1301 code. Then on 2/19 received a deposit date of 2/20. My refund was deposited on 2/20, but instead of the 1101 that I expected, the amount was 285. I guess I will be calling the IRS on Monday to find out what is going on. Ugh.

    I also got a 1301. I received a DD for 2/24 and I checked in 2/27 and the money was not there. Today is 3/3, its been a week and nothing!!!

    Got a DD date of 2/10 and then no money but the code 1301. I have called weekly and was told on 2/28 that it would go in the next check run. It still hasn’t been changed to a new DD. Incidently when I called and they asked me to verify my address, they didn’t seem to have my new address in the system so I wonder if they even looked at my return yet.

    I had a direct deposit date of 2/24 and then it changed to the 1301 code, too. I have not received anything; it’s been more than a week. I’m not wasting my time on the phone, though. Thanks everyone for posting here to give some insight of what’s going on.

    I had a 3/3 date and have the 1301 code. Every time I call I get a different answer. No one can give me any idea when my refund will be here. It has been two weeks now and still no clue!

    another 1301-er here. Filed & return was accepted on 2/23. Was told that my DD would be there by/before 3/17. Then on 3/18 I was shown the 1301 code. The rep I spoke with told me it was in error resolution, but couldn’t tell me why, and said “they usually fix it. Call back on 3/24, we can’t check into it further until then.” Called today 3/24, told the rep that I looked up the code and it just means a delay & it seems that most who are getting this code are getting large refunds from stimulus packages (either the recovery rebate credit or first time homebuyer credit) and he just kinda skipped over that, only acknowledging that those things existed and yes a lot of people filed for them. Hrm. He told me that he doesn’t see a problem with the return and that they “usually fix it” internally…and since he doesn’t show that a letter requesting more/corrected info has gone out, that usually means there’s not a huge problem & I should get my money soon. I asked if maybe they just hadn’t gotten to my return yet, he said that they “usually get on these things pretty quick.” Um, it’s been a month, that’s not quick!
    Anyway, he told me to check this Friday 3/27 & next Friday 4/3 online to see if I got my money yet and then call them back if I haven’t. Sigh.

    Had a DD date of 3/6. On 3/6 went into 1301, it’s now 3/26. Called IRS agent told me I would receive a letter in three to six weeks. Asked why she didn’t know. I have been paper audited befor but that is a different code. I’ll check Friday to see if anything has changed.

    I filed on 3/5 and rec’vd a note stating that my DD would be 3/27. That never happened. When i called the IRS, i was told that it was reversed and was given a code 1121 online. Now I’ve been told that I will receive a letter dated 4/13 and then I “might” receive a refund within three weeks after that date. I couldn’t get no other info over the phone from the IRS.

    I have been at code 1201 since I e-filed January 26,2009, return was accepted same day, I keep getting the run around, I did receive cp-05 letter March 3, waited the 3 weeks and called and was told my taxes were in the examination dept. I just want my money, plus interest, if I owed them money they would not hesitate to charge me penalty and interest,there are so many of us going through the same thing, maybe the gov.spent all the money bailing out the auto makers, and banks…

    I files on 1/26 was accepted same day .Suppose to get return in 8 days nothing . Called the Irs they did not know , said call back in 3 weeks . Called back they gave me a tax advocate , tax advocate said I would get my return end of April . Did not recieve anything , called TA told me another department was looking at my return . Last Monday recieved a letter from the IRS that I would recieve my return in 6 weeks , though the IRS site stil says there is a delay in my return ?? Tax Advocate says I will not get my return because another department is looking at it . Who to believe ?? HELP !!

    I filed on 01/16/2009 and it was accepted same day, I was suppose to get my refund in two weeks, then I was on 1201 code, I called they sent a cp-5 then another letter requesting some info. I sent it and still not recived my money….every time I call is a diferent story…this is increible…..

    I filled my tax since last week of Jan and still have not received it and we’re in Jun going to July…This is a bad mistake from the Irs or who’s ever it is at fault!I call after 6 weeks they told me to wait 6 more and so on… got referred to a advocate office which send me a letter a week after saying they couln’t do nothing because the irs was still working on it.Called again and told them that Jun 16th pass and I have not received my refund and now the status change again in the wheres my refund to code 1301??? God only knows what that is because I have been given so manny codes and this is the most recent one.I hope this will be the last one.I hope is true what some responses are saying that it will take only one more week.Only God knows How much I need this money!

    Got the error code 1301…. Was to have my refund on 2/16/10… Called IRS and they said I will get a letter that will show that I need to provide more information. I see many people had the same code but didn’t have any problems. I have been filing the same way every year and not sure why there is a problem… Looks like I won’t get a refund before April sometime… IRS was not very helpful..

    Also got it this year after getting a delay on my refund today.

    In my case thought it had something to do with the application of the first time homebuyer’s credit and owing taxes on 2008. So that was one way to find out…

    I’ve got the best one.I filed (e-file)on 2-10 should have recieved 2-22 instead my tax’s where under review and then they(irs) put 708.00 (of 4708.00) in my bank account.I check status again and it says will send letter receieved letter and it says they (irs) will contact me in 3 weeks .Nobody to call no number no nothing.What kinda of crap is this .Has anyone else have this happen to them .

    O no don’t say that I have been waiting on this 1301 thing for two weeks already and I believe it has something to do with education credits this year. I really wish I just went to HR Block instead screwing around with Tax Act. I too was given no real information when I called, he told me that the return was sent to a different department of the IRS and I couldn’t contact them and that they might send me home a letter in the mail in three weeks. He said it could take up to three weeks to get the letter and another two to four weeks to fix the errors and refile my return. I cant believe they can do this to so many people I mean if it is a delay then just say theres a delay!

    We’ve been waiting for 2 weeks now on reference code 1301. When we called we were told that if we haven’t received a letter yet then this is a good thing. All tax returns are processed through a computer first and if the computer finds no problems or questions then you’re issued your refund. A human never sees your return. If there is a question (and it can pertain to anything) then it goes onto someone’s desk (code 1301) and there it will wait.. and wait.. and wait.. until the human gets to it.

    I received the same error code and was told by the IRS agents that a letter had been sent to request additional information. It’s been two weeks now, still no show. Maybe its glued on to a snail and its still making its way to me. Just wondering whether or not you actually received a letter from them. I’ve been reading different posts from various sits and some individuals indicated the same problem but when they called the IRS again, they were informed that a letter was never sent. I live in New York…the number of the letter they advised me that was being sent was letter number LPR4612. Anyone else receive such a letter and, if so, what information are they requesting? Thanks.

    I E-filed on Feb 1oth 2010 through Turbo-Tax and was given a est date of Feb 26th. The IRS website said by march 2nd. Then I was given the 1301 code on March 3rd. I have talked to numerous people like you all have, been told different stories, but they all say I did nothing wrong it’s a system error (something to do with the new work credit this year). But AGAIN…nothing I did??? Well then what’s the problem? Last week I was told 4-6 weeks from March 4th, and today I was told 6-8 more weeks. They also keep saying they updated the notes for me so it should make things faster. BULL!!!
    I am frustrated and I am calling my local IRS office in the AM. Please do this also and maybe we can figure this out. I have not heard of anyone getting their taxes after they have received this code. Has anyone?

    I have an accountant that does my taxes and several other people taxes in my circle,he used the Tax Act program for all our taxes on March 4th and we were told expected date of arrival would be on the 12th.However none of us received a dime in our accounts and once checking the IRS web regarding our status we all received a new arrival date of March 16th and once again know one reeived a dime. Therfore I called IRS spoke with a Rep and was told my taxes was being processed and to give them another week,I asked was there a problem on my end and the Rep stated know we’re just delayed. well two days later we all rechecked the web to see if any of us received a new arrival date and notice we were all given a reference code 1301. However I did call the IRS regarding this matter and was informed my taxes is still being processed which could take up to two weeks. Any Suggestions!

    Did anyone get a refund after getting code 1301. my return of over $10000 was accepted on march 4th with DD of 3/16 but nothing then code 1301 for a day 17th then a new date 3/30.

    I have the same code. That’s our government in action for you. I filed electronically…this should be automatic. My state return was in my bank account in a couple days. I think it’s the fed’s way of delaying paying your hard earned money back to you, so they can float the interest a little longer…or possibly so they can have more time to print more cash. Do you think there’s a correlation between the delay, and the fact that our elected officials are on a spending spree and bankrupting the country? Some of the more financially strapped states are delaying paying out refunds until the fall or the end of the year.

    out of curiosity, how may of the 1301ers did their taxes through turbotax? I used trubotax to file this year, as in years past, and don’t recall having entered the information from Schedule M (having to do with the stimulus money), but there it was, incorrect. Is this part of a bigger problem with Turbo Tax?

    I am so upset..I did my taxes and overnighted them fro the home buyers credit. I recieved a confirmation the IRS signed them and accepted them on Jan 27th…I recieved notification that they would be deposited on March 16th and then again on March 23, then April 6, and then April 13th , and then April 27th and now I get the code 1301…so I called the IRs and of corse they tell me it is just another delay

    I too received this code. I had to file a paper return, as we were receiving the First-time Homeowner’s credit. I filed at the end of January, but the IRS didn’t receive my return until Feb. 25th. I was issued an inital refund date of Mid-March. It then turned into Late March, then Early April, Mid-April, Late April, Early May, and today (4/19/2010) I received the 1301 code. I called the number indicated on the WMR website and got almost no information other than that they would forward my case to an advocate. After that I called 1-800-829-1040 (select “0″ several times and it will forward you to an operator) and finally got a few answers. In my case, the IRS is “reserving” 11 weeks to process returns with the homeowner’s credit. Since this was over the 6-8 week advertised processing time, I was assigned the 1301 code. I was also told that they are having a hard time making the computer recognize my return and process it. I have no idea what that means, but apparently they hope to have it cleared up shortly. I was told that I should receive my DD somewhere around Mother’s Day. I will let you know if it really happens. I tend to agree that the IRS seems to be dragging their feet on returns that are of high $$.

    I filed in early February, saw a 1301 code by mid March, and now it is almost May and I haven’t seen or heard anything. It has been 11 weeks since I filed and the IRS website still shows “1301″ and “we have received & are processing your return”.

    I’m disheartened by the fact that no one that has ever gotten a 1301 has admitted to being paid, ever. How can the government get away with this? I’m in a financial hardship and could really use my return. I wish my bill collectors were as gracious with me as I am apparently being with the government.

    I efiled in January, accepted on 01/23. I was suppose to receive my refund on February 5. When I checked I got error 1301. I called IRS, was told that a letter was coming to allow two weeks.I received my letter on Febuary 16, mailed back Feb 22,2010. I followed back up on 03/26 was told that it will be out of “hold” on March 30 and that it will go into error resolution for processing and once completed from there it will go into the electronic system for processing(additional time from error resolution). I called back on April 16 was told to allow 4-6 more weeks. Tomorrow, will be 4 weeks in error resolution. UGH!!
    I just finish paying for Prom.. now I’m broke … come on I still have graduation to go..

    I will be receiving my return via DD on April 30, 2010, however it will be for $8000 less than my anticipated return. The IRS is disallowing my First-time Homeowner Credit, but no one can seem to tell me why.

    For those who have asked, unsure about 1301, but have seen a couple of accounts regarding people receiving 1201’s in prior years where they did receive their return. 1201 and 1301 seem to be related/similar, so…I know “injured spouse” returns are manually reviewed, and average 3-6 months for receipt. Which falls in the the unfortunate 5 months reported by the above 1201 people that it took to get their money. Sorry that’s the answer! Mid-September doesn’t do much for me, either!

    In the same boat! filed 02/17, every weeek my date would leap forward two weeks now its 05/11 and I have had an error 1301 for the last two weeks. refund is over $20,000 due to a legal settlement where they sent a set percentage to the government. I think its crazy that the media hasnt picked up on this, seems like it would be a great story! They need to be paying interest!

    Files by mail first week of February 2010 because of first time home buyer credit. Called after 6 weeks of WMR saying “No Info available” told they had no idea, my 2010 wasn’t in the system yet, wait at least 2 more weeks because ist time home buyers credit was taking 8-12 weeks. At 8 weeks the WMR changed to by May 11th I would receive my refund. I got a letter at about 10 weeks asking for a copy of the closing statement on my home which had been attached when filed and faxed back on April 29th. WRM remained May 11th until the 12th of May when it changed to Code 1301. Called on 14th of May told no idea if the fax had been received, or what the status was, only that I was “being processed”.

    I guess I’m a “1301″, I mailed my return on Feb. 26th due to homebuyer credit of $6500. I got a date in May to expect direct deposit but now the website just says my return has been received and is being processed. I’ve been told the IRS made an error that has now been corrected, that the error resolution department is handling it, that calculation of interest because of the delay is causing a delay?!, and finally by one woman that she has no idea what is the problem — one rep. told me it could take 14 months!!! Don’t plan on getting your money any time soon…

    I used TurboTax too, and was a bit baffled by the question about how much my stimulus check was actually in the amount of, so I put what they stated to be “most common.” I wonder if perhaps that was wrong. TurboTax printed this one page that I’ve never submitted before, related to the stimulus check.

    I filed right around 4/15/10 in Texas, and got error Code 1301 at first when I checked up on this a couple months ago, just rechecked today and see error code 1201. Don’t know if it’s a good thing that it has changed but I can see from here that calling the IRS will not help, so I’m just going to hope it comes in September and figure out my finances for now without it.
